Abstract

Religious freedom has been a cornerstone of democratic societies, with its roots embedded in constitutional frameworks that protect individual rights and liberties. The relationship between religion and the state has evolved over centuries, with significant historical, cultural, and legal developments influencing contemporary debates on religious freedom. This article delves into the historical roots of religious freedom, focusing on the role of constitutions in shaping the relationship between the state and religion. Through an analysis of both Western and Eastern constitutional frameworks, it examines the current challenges surrounding the interpretation and application of religious freedom in diverse political and cultural contexts. The article also critically analyzes how these debates influence contemporary legal frameworks in Pakistan, drawing attention to key constitutional provisions and judicial interpretations. The historical and legal perspectives presented in this article offer a comprehensive understanding of religious freedom’s position within the broader context of constitutional law.
